<title><![CDATA[Iron Man - Film Review]]></title>

<content:encoded><![CDATA[<p>Iron Man is another in the trail of the Marvel Comic to film conversions, and could just be the best yet. Generally speaking, the comic books turned films have been very good - Spiderman, Batman, X-Men, all to me were very enjoyable. I have to admit, Iron Man to me is one that I can't remember at all from childhood, and even the trailers couldn't fully entice me but I went along to see it anyway.</p>
<p>Iron Man follows the script that you would expect, with lots of CGI, one central 'hero' character, and an outlandish plot to wrap it all together. Even though they all have similar themes, what makes each one unique and different is the hero. Apart from X-Men, all the others focus on one character, the hero, and it's this that makes each film enjoyable in its own way.</p>
<p>This also means that the actor playing the hero role has to be perfect. If the casting of the main character is off, the film is absolutely doomed. Fortunately, Iron Man is played by Robert Downey Jr who completely makes the film what it is. His character Tony Stark starts as an extravagant billionaire, living the playboy lifestyle in casino's and living day-to-day. Stark then goes through a major emotional journey, going through various attitudes towards his work and colleagues, before ultimately deciding what to do with his money and his engineering talents. It's done in a likeable way though - one thing (maybe the only thing) about one of the Spiderman films that annoyed me was that Toby McGuire turned into a goody two shoes overnight, and dumped (before getting back with) Kirsten Dunst in order to save as many people as possible. I know its noble and a hero is supposed to be like that, but its still annoying. Iron Man is a good guy, but he does the right thing for his own good and for his own revenge against the people who originally kidnapped him - not because the villain is a threat to society or anything sad like that. So even though he should be a bit of an asshole, he's actually very cool and likeable, and crucially, not annoying or frustrating to watch. Just the opposite in fact.</p>
<p>CGI effects are very good throughout the film, and are done in a similar way to the Transformer film. It looks realistic and tangible even though it is obviously done on computers. The Iron Man Suit effects are shiny and eye-catching, even more so than Spidey's undies, and the mechanical components that pop in and out shooting missiles and what not, are sublime.</p>
<p>The storyline is a bit silly, even for me, but I'll forget about that. You know its not going to be based on real life events or anything serious so who cares. The ending is a bit OTT but satisfying nonetheless (and wide open for a sequel).</p>
<p>Pepper Potts, played by Gwyneth Paltrow, has the somewhat typically role of the obedient, under-appreciated, plain yet secretly glamorous assistant to Tony Stark. Although everyone else thinks she was great, I think the role could have been better cast. This is being a bit picky because she does do the role OK, but for such a good film you would expect slightly more from her.</p>
<p>Iron Man is a great film to watch - thrilling, fast paced, frequently comical and absolutely owned by Robert Downey Jr who makes the film what it is almost single handedly, without him, the film would have been only a 5/10 and you can't imagine the role going to anyone else after seeing him in it.</p>
<p>Overall - <strong>8.5/10</strong></p>

<p class="MsoNormal" style="text-align:justify;">The letter Y is inciting the modern American baby naming imagination like no other.  Y is currently enjoying a disproportionate renaissance, and is being inserted at random to make a name one's own.  From Alyvia to Zoey, Alyxandra to Zsophya, people are taking perfectly beautiful classics like Olivia, Zoe, Alexandra, and Sophia, and creating invented forms by using Y as a vowel (A, E, I, O, U, and now Y more than ever). Revisiting my list of common K names, let's try trading the K for other popular letter combinations (see <a href="http://youcantcallitit.com/2008/05/26/the-seven-deadly-trends-part-5-k-kraze/">K Kraze</a>.  We arrive at Shayley, Jayla, Braylin, Rylie, and Myleah.  Sound familiar?  The letter Y replaces Is and Es, and is being made to rhyme with I and E as well.  Confusion arises.  Not only are spellings no longer intuitive, but pronunciations aren't either.  Let this be clear: misspelling a name, be it with a Y or otherwise, in no way makes a name unique.  It will make your child part of a greater trend in which Americans are distancing themselves from the English language, from "ur" instead of you're/your, to "gr8" in lieu of great.  Remember that a child's name belongs on a diploma, not just in an instant message.  </p>
<p class="MsoNormal" style="text-align:justify;">Y is for the most part, but not exclusively, being relegated to girls.  According to Roy Feinson in <em>The Secret Universe of Names</em>, girls are thirty times as likely to have a name beginning with a Y than boys.  Whether it begins, ends, or is within the name, Y bestows a youthful feel, which can sometimes border on the infantile.  If the Greek i itself is what you're after, the Greeks and the Welsh have a plethora of more sophisticated traditional Y names to choose from.*</p>

<p style="text-align:justify;">Si un peu, vite fait. Tracy Anderson c'est la coach du moment. Celle qui a fait oubliée la Guiness et la friture à Gwyneth et donnée <em>trois biceps en plus</em> un coup de punch à Madonna, tout le monde le sait, tout le monde en parle surtout à L.A. Tracy, danseuse yoga-pilate-fitness girl, a laissée son diet program sur le net. Je l'ai lu mais perdu de vue. En gros, elle dit qu'elle peut rendre n'importe qui super ultra slim. Quand j'avais lu son régime et les exercices à faire, je suis restée septique. Déjà côté exercices, pourquoi pas. Mais côté assiette...là, je trouve que ça déconne sec. Il faut dire qu'elle n'a pas été élevée en france donc,  la perception de la bonne bouffe est bien lointaine de la mienne. Je ne cherche pas à prôner quoi que soit en frimeuse innée de la table, il y a que justement, même ici aux states, des palets savent aussi se nourrir.</p>

On sait que dans un régime vaut mieux caler le copieux en début de journée plutôt que le soir et puis faire du sport demande de l'énergie...</p>
<p style="text-align:justify;">Si vous êtes tenté par une autre technique, Demi Moore nettoie son sang avec des sangsues, pas n'importe lesquelles, des Australiennes, des chevaux de courses du pompage de veine. Et oui, elle en raffolle, adore et se sent vraiment detoxifiée juste aprés sa scéance.</p>

<p>Iron Man is a comic adpatation to film from the Marvel Entertainment Group which made the comic itself. It stars Robert Downey Jr. as Tony Stark/Iron Man, Gwyneth Paltrow as Pepper Potts, Terrence Howard as Jim Rhodes, and Jeff Bridges as Obadiah Stone.</p>

<p>Now if you don't want to read all of this because it is tl;dr well folks I just so happen to have made a quick review last night after the movie. Here it is...</p>

<p>The movie starts off on a good foot and never missteps. From the very beginning opening scene of comedy flowing easily into action follows the path throughout the movie. This can be attributed mostly to the directing talents of Jon Favreau who has a comedy movie past. He proved on Zathura he could do action and here in Iron Man he proved he could adapt a comic book into a movie almost perfectly.</p>
<p>What's interesting to note is that throughout the film there are various assorments of different techniques to go on to the next scene. There was a blend in, a side swipe, and quick cutting all throughout the movie and I for one loved that there really was no set style for this movie other than it's story.</p>
<p>The story is pretty much true to the comic itself as we see Tony Stark battle himself more than the actual enemies. Stark is a complex man and you need a complex actor to play him and Robert Downey Jr. fit the bill. Downey has had his own life problems and seeing him use them to make Tony Stark a more fully enriched character is something I want to see more than once. Downey proves that he is one of the greatest actors of our current time.</p>
<p>Don't get me wrong Downey pretty much is the movie but the cast of other characters is strong and important to the film as well. Paltrow and Terrence Howard play their buddy parts like they only know how and Jeff Bridges brings in a great performance throughout as Obadiah Stone.</p>
<p>What I like most about this movie is the secret nods to the comic book fans of the movie. We got hints of S.H.I.E.L.D., War Machine, and staying true to how Stark handled the press about Iron Man.</p>
<p>Overall, this movie is everything you want in an action movie and more. It gives you sense of satisfaction and that's what you really go into a movie theatre hoping for. While I'm a Spiderman fan outright I can tell you that Iron Man is the most complex character and it elevated the movie as one of the best comic book movies of all time.</p>

I'm a middle aged, working class man living in the West End of Crewe; formerly employed in Crewe Works prior to its destruction by Tory and Thatcherite policies. As someone who remembers vividly the disgraceful contempt with which the Tories treated northern working class communities during the 1970s and 1980s, I am saddened that many of my fellow Crewe residents are considering voting for this sham of a party. This blog will be updated daily, detailing the elitism of the Tories, the snobbery of the leadership, the weaknesses of its policies and the reality of the toff they've got standing for election in Crewe. <content:encoded><![CDATA[<p><img class="alignleft" style="float:left;" src="http://melancholiac.files.wordpress.com/2008/05/ironmanposter11.jpg" alt="Iron Man Poster" align="left" /> <em>This was one of the more anticipated movies for the first half of 2008.  But as with all big-name-big-buck movies, there were huge expectations, and usually the movie bombs.  But with the first installment of Iron Man, it definitely exceeded my expectations.  Unbelievably high-tech yet slapstick at the same time, the movie hinged on a very consistent light comedic dialogue between all the characters.  The cast was very well picked out as all three main characters did superbly well in their respective roles.  The story line was also pretty good and consistent with the dilemma Tony Stark really had in the original comics.  But the most impressive part in the movie was definitely the armor!  The guys who did the rendering of Iron Man's armor did an amazing job, and when you see it in the movie, you will be in awe, as I was :)</em></p>
<p>Iron Man is a story about a wealthy philanthropist named Tony Stark, who is a filthy rich carefree billionaire industrialist and inventor.  The movie starts off with Stark showing off his latest creation in weapons technology and then gets kidnapped by some Afghan rebels.  As it turns out, most of Stark's weapons were being bought out by this same group and was being used to destroy innocent neighboring countries.  He wakes up in a cave with a huge metal plate in his chest powered by a car battery.  Apparently, the shrapnel from his own weapon had pierced his heart and the mechanism in his chest was the only thing keeping him alive.</p>

<p>Stark is then forced to build a diabolical weapon, but instead uses his ingenuity to create an indestructible suit of armor to escape his captors.   He then discovers that he knew very little of where his weapons were going and vowed to rid the world of the same weapons he had created.  With his new found conscience and zest for life, he creates a brand new suit of armor to help him in his mission.  And from here, you will see the process of the creation of his armor as well as the character roles being developed very well.</p>

<p>Robert Downey Jr, may just be the perfect actor to have portrayed Iron Man, and may be the best fit to a superhero since Hugh Jackman for Wolverine.  If you are familiar with the cartoon series long ago, he looks very much like Tony Stark.  And Downey Jr. played his role to a tee mixing arrogance with comedic aptitude that was a pure joy to watch on-screen.  Gwyneth Paltrow co-stars as his secretary, “Pepper” Potts, the shy-yet-feisty sidekick who's not so secretly in love with her boss. I never liked her, but she looked quite amazing in this movie.  And playing the wily Obadiah Stane is Jeff Bridges, in probably the best role I've seen him play.  He seems revitalized and was also perfect for the role in his shaved head and beard. Bridges challenges Stark's new found idealism at every turn and was also a great joy to watch.</p>

<p style="text-align:left;">All in all, the movie was very entertaining and fun to watch.  I would most definitely watch it again, and I'm going to buy the DVD when it comes out.  If you haven't seen it yet, please do yourself a favor and make sure you do on the big screen.  There is nothing more amazing than seeing this movie in all its glory in the theaters.  The way the technology of the armor was shown while it was being built, as well as when Tony Stark dons the final version was awe-inspiring.  There was never a time in the movie that I got bored, and it was entertaining from start to finish.  Oh, it was also great hearing Terrence Howard say "maybe next time" after seeing another armor set in Tony Stark's tech room.  It means we will definitely see a second installment of this movie and I can't wait for that one!</p>

The Labour Party have organised an opportunity for you to leave a "tribute" to the late, great Gwyneth Dunwoody. I didn't always like her politics but, there was never any doubt where she stood &#38; she spoke her mind. Something which appears to be lost forever among her cynical colleagues in the parliamentary Labour Party.</p>
<p>As if to prove the point, even this tribute to Gwyneth is not what it seems. <p>A close study of the data capture process reveals that it includes a sophisticated software routine designed to look-up and verify the postcode and collect the data for Labour HQ in London. This is not a spontaneous local initiative - it was designed by Tangent Labs, the Labour Party's national e-campaigns software contractors.</p>
<p>The Labour Party appear to not to understand basic standards of decency. Everything is used for political opportunity, even the death of one of its favourite daughter. It's cynical and its sleazy but, the Labour Party just don't get it!</p>

Ele é meio alcoólatra, mulherengo e um fabricante de armas, mas é tipo um Howard Hughes, um pouco imprudente. Eu interpreto Pepper Potts. Ele é assistente do Stark. Sua confidente. Ele é a pessoa mais próxima que ele tem. Pau pra toda obra, sabe? Eles têm essa relação mútua, até meio fraternal, mas também um pouco sexual e muito divertida. Enquanto ele é porra-louca, ela é meio que a consciência, a parte moral sempre tentando dominar.</span></em></p>

Ele e Johnny Depp eram os dois atores com quem sempre sonhei trabalhar e por isso foi sensacional quando me chamaram e disseram que era um filme do Jon Favreau, que fez filmes que adoro, e que eu iria atuar ao lado de Robert Downey Jr., Terrance Howard e Jeff Bridges... Só pude dizer "Ótimo! Onde eu assino?" E só depois perguntei sobre o que era e me contaram que seria uma adaptação de quadrinhos do Homem de Ferro. E eu falei "Legal e como é?" e assim fui me familiarizando com aquele universo e fiquei muito feliz. Me diverti muito.</span></em></p>

Ele não tem amarras, mas quando está trabalhando se dedica totalmente e tenta as coisas mais geniais. Ele é um cara ligado no 220V, sabe? Você não chega ao fim do dia se arrastando. Sempre tem algo inesperado quando ele está por perto.</span></em></p>

Me puse a revolver, y habia todos títulos viejos y clásicos, aunque había algunos que zafaban, y entre ellos encontré la comedia "Shallow Hal" (Amor ciego) con Jack Black (School of rock) y Gwyneth Paltrow (Shakespeare in love) y me la compré, porque siempre la habia querido ver. Me encantan las comedias, y esta es buena, no es la mejor ni es buenisisisisima, pero esta linda, graciosa y ademas te deja pensando.</p>

<content:encoded><![CDATA[<p>I'm not a fan of uploading too many pictures on this blog because once you exceed a certain amount you can't put up any more new pictures, unless you subscribe to the premium wordpress or something. But, having used wordpress &#38; formerly blogger, I'm still very much a fan of wordpress for it's simplicity and aesthetically prettier intersurface. I'm such a sucker for anything neat &#38; tidy (not pertaining to the condition of my room during exams though).</p>
<p>Anyway, I just couldn't resist uploading some pictures of my dear niece. Even though she really does not seem to like to smile to the camera. Or rather, when she is conscious that something big &#38; black is in front of her (my phone camera) she'll suddenly go into this tranquil mode and dares not blink. (Talk about being camera-ly aware) Or how she is chatty and demands attention by increasing her volume everytime someone refuses to talk to her, but when my sister stuffs the phone in her face to make her chat to her daddy in Jakarta, she goes mute.</p>
<p>Yup, she's awfully cute, even though 90% of the time, she never smiles at the camera. And here is why I love her so:</p>

<p>Visto a clarificação dos ‘coisos' não ter clarificado quase nada, a Gwyneth publicou no seu blogue uma Petição, que nos blogues portugueses, só foi reproduzida em dois - emendem-me se estou errado (em Portucalis e no Geta).</p>
<p>Os responsáveis pelos outros blogues ficaram esclarecidos e satisfeitos com a resposta dos ‘coisos' ou só alinharam porque enfim, ok, acho que sim, cá por mim, vamos nessa, é preciso estar na onda?</p>
<p>Sem mais preâmbulos, as perguntas realmente incómodas:</p>
<p>1. Quais dos blogues que publicaram o Manifesto original da Gwyneth farão greve?</p>
<p>2. Mais importante: quais as pessoas que postam nesses blogues farão greve não entrando inworld entre os dias 15 e 18  deste mês?</p>
<p>3. A Gwyneth também fará greve não entrando inworld assim como a empresa* a que pertence (e que depende dos ‘coisos')?</p>
<p>Dia 15 está próximo... quero ver ... (o 25 de Abril também está próximo) :-)</p>

<title><![CDATA[Petition to Linden Lab on the Policy of Trademark Enforcement]]></title>

<p>Linden Research Inc., a company incorporated in Delaware, United States of America ("Linden"), doing business as Linden Lab®, developers of the Second Life® virtual world platform, owners of not only the Second Life® registered trademark (in the US, Europe, and other countries), and the eye-on-hand logo, but also of several recently registered trademarks (including, but not exclusive, to the words "SL", "SL Grid", "Second Life Grid", "2nd Life", etc.), has launched, in May 2004, the "Second Life® Fansite Toolkit", which was later reinforced with referral programmes like "Viva La Evolution", to positively encourage the widespread use of Linden's trademarks, so long as it was quite clearly displayed that no infringement was intended, and a disclaimer to non-affiliation to Linden.<br />
A direct quotation of the <a title="SECOND LIFE TRADEMARK USAGE POLICY FOR FANSITES" href="http://docs.google.com/Doc?id=dcnd4nw6_92k5tktqcv" target="_blank">previous accepted use</a> includes the following paragraph:</p>
<p>USE OF SECOND LIFE MARKS</p>
<p>While you are in full compliance with the usage guidelines described here, you may use the "Second Life" name on your website, as well as the related logos and graphics available at Toolkit, solely in the form described there. Additionally, you may use screenshots from Second Life to the extent that Linden Lab has the right to authorize use of the content within such screenshot, including screenshots of Linden in-world objects and Linden avatars, subject to these usage guidelines.</p>
<p>The full text of the acceptable use of Linden's trademarks is published <a id="lskh" title="here" href="http://sl.governormarley.com/slpress/?p=27">here</a>. Three versions of the Fansite Toolkit <a id="ixwh" title="were distributed by Linden" href="http://static.secondlife.com/downloads/SL_Fansite_Toolkit_3.zip">were distributed by Linden</a>, which included banners, logos, and a set of images, as well as a PDF encouraging their dissemination (the link is not available any more).</p>
<p>Under these gentle terms, users of the Second Life® platform have set up dozens of thousands of websites, blogs, forums, 3rd party services (both inside the Second Life® environment or on the World-Wide Web). The intended purpose of the "Fansite Toolkit" was not only accomplished, but overwhelmingly effective. From about 10,000 registered users in May 2004, the number of registrations climbed to over 13 million users in March 2008, and the growth continues - as well as the growth in the number of fansites related to the Second Life® environment. A quick search on Google comparing the number of times "Second Life" is referred on Linden's own sites (9000+ results) compared to what the non-Linden sites (24 million results) shows quite clearly that the promotion and marketing of "Second Life" as a Linden product is, by far, being done <em>outside</em> Linden's own feeble efforts - as it was intended.</p>
<p>The terms of the "Fansite Toolkit" enabled furthermore a small startup company in San Francisco, without any advertising, promotion, or little public relations in 2004, to create one of the most effectively known technologies on the Internet, enjoying raving press reviews in late 2006, and, since then, a product and an environment that cannot be further ignored by the mainstream. Like it or hate it, the Second Life® virtual world is now part of the Internet's history. All this was achieved thanks to the huge community of very enthusiastic users of Linden's platform, who have promoted its use way beyond Linden's own ability to market their own product.</p>
<h3>"Genericide"</h3>
<p>The secret of Second Life®'s success was, however, accompanied by an adaptation of the word to describe not only Linden's product, but a <em>new concept</em> that did not exist before: a community of users that generate content in a shared environment, using Linden's tools and Linden-managed computer servers to provide an interconnected grid where this content can exist. The usage of "Second Life" was never strictly associated with the client software (the 3D viewer installed on users' computers), the server software (running on Linden's servers), or the communication protocol (which, until recently, was even unnamed). Rather, "Second Life" was employed, for the past four years, to describe <em>all the above together</em> as a technology empowering user-created content in a virtual world environment using Linden's technology. The subtle difference has, however, huge implications. "Second Life", as employed on the 24 million links stored by Google,<sup><a id="j6wj" title="(ref)" href="http://www.google.com/search?q=%22Second%20Life%22">(ref)</a></sup> describes not patented software (the Second Life® client is, indeed, free and open source) nor a "technology", but an "environment", a "virtual world".</p>
<p>The situation is very analogous to the usage of the terms "World-Wide Web" or "Internet" (the latter having at some point been trademarked by Microsoft around 1995, with little success), both describing a certain use of several technologies, hardware, software, and telecommunications, but where no definite claim can be made on the resulting <em>environment created by a community of users</em>. Derivative words like "Internet Service Provider" or "Web consultant" are popularly used. The difference between those two terms is that no organisation currently managed to secure a claim to those names.</p>
<p>But further examples are also common, where registered trademarks have been adopted by a community of users generating content for their platforms. Thousands of sites and technologies have used the term "Mac" in their names, or even "Windows" (clear cases where the respective owners, Apple and Microsoft, have indeed solidly claimed their registered trademarks). "Mac" and "Windows" fansites abound and help the promotion of these technologies and platforms. The difference, in those two cases, is that the popularity of those technologies was <em>heavily</em> promoted by their owners through massive advertising and public relations. And <em>still</em> both companies "allow" the widespread use of their trademarked names in 3rd party websites, fansites, service providers, or even products!</p>
<p>Second Life®, by contrast, never enjoyed the same level of promotion <em>by Linden</em>. It relied on the "Fansite Toolkit" as the primary - and most successful! - way of "viral marketing", effectively <em>crowdsourcing</em> the co-promotion of the Second Life® virtual world <em>by its users</em>. And these, obviously, were very eager to do so - since <em>all</em> participants in the virtual world, Linden and their users, benefit <em>tremendously</em> from this cooperative promotion. "Your World, Your Imagination", Linden's motto for their Second Life® virtual world platform, was taken to an extreme, and perhaps unprecedented, level in the history of technology dissemination.</p>
<p>Linden, however, now fears (probably very correctly) that the usage of Second Life® might fall under "<a id="rydq" title="genericide" href="http://en.wikipedia.org/wiki/Genericide">genericide</a>".</p>
<h3>Recent developments</h3>
<p>Possibly advised by their legal advisers, Linden announced <a id="a21t" title="here" href="http://blog.secondlife.com/2008/03/24/introducing-the-second-life-brand-center/">here</a> and <a id="i8ze" title="here" href="http://blog.secondlife.com/2008/04/01/more-on-the-trademark-policy/">here</a> that they would start as of now to aggressively discourage the usage of all Linden-related registered trademarks, thus effectively reverting its four-year old policy of co-promotion through marketing crowdsourcing. The major issue with the current population of Second Life® users is that dozens of thousands of products and services were created within compliance with the old guidelines, and there is no provision made by Linden to "grandfather" existing services now currently in existence. Almost all have no legal protection that will allow them to contest any of Linden's claims in court to shut their services down if they receive Linden's Cease &#38; Desist letters. Linden's claim to their trademarks is, naturally, factually correct, unambiguous, and entirely within Linden's rights.</p>
<p>There is, however, one aspect of Linden's claims where we feel the Guidelines are overshooting the legitimate intent of Linden Research in preserving their trademarked brands and preventing their dilution. We refer to the section "<a id="mkwz" title="Proper Reference to Linden Lab's Brand Names in Text" href="http://secondlife.com/corporate/brand/trademark/reference.php">Proper Reference to Linden Lab's Brand Names in Text</a>", which basically outlines how <strong>any</strong> mention of terms trademarked by Linden has to be written <strong>any</strong> text published. Among other things, it claims to make sure the brand names are only ever used with an "appropriate generic noun" of which Linden provides a list, and that "as often as possible", down to capitalisation, spelling, elisions and contractions. In effect, this precludes any usage of trademarked terms in text in most of the forms current nowadays, and dictates to commentators, bloggers and critics how and what to write when referring to trademarked terms.</p>
<p>The issue, however, is even more serious. Although Linden's prevention of the use of trademarks under the new guidelines could be contested in court, either in the US or elsewhere, possibly appealing to estoppel, as a matter of fact, Linden can - through its new Terms of Service, that <em>all</em> users required to sign to access <em>their</em> content on Linden's virtual world - simply <em>ban</em> any user that Linden considers to be in violation of their trademark claims. By virtue of the same principle, Linden can simply ban any user that exerts his or her rights to free speech, nominative use of trademarked terms as laid down by US law, or equivalent rights under local legislation.</p>
<p>This is "doing justice with your own hands" - without laws, without trial, without a jury, without recourse. The Linden Terms of Service allow Linden to ban any user from using their services, <em>without any reason whatsoever</em>. Linden can, at whim, delete accounts and content (even copyrighted content) from <em>any</em> user without a complaint.</p>
<p>Granted, complaints can be filed against Linden - but in a court of law. In at least one case (Bragg vs. Linden), a user of the Second Life® world managed, through a lawsuit, and with a settlement agreement, to get access to his content back. But this requires effectively users to <em>sue</em> Linden in order to get their access <em>back</em>, no matter if they are or not violating Linden's trademarks. Linden does not require any <em>impartial judgment</em> to validate a user's claims on the lack of violation. Linden can safely ignore their four-year-old policy and revert their decision at whim - because they can ban accounts that refuse to comply with their new Terms of Service.</p>
<p><strong>In effect, Linden is able to enforce their own interpretation of the usage of their trademarks by banning all content they view as "threatening" to their claims on registered trademarks, no matter if it is displayed inside Linden's virtual world or anywhere else on the world. Linden's decision to ban avatars and remove content is unilateral and not appealable unless a user is willing to sue Linden in a court under the jurisdiction of the State of California.</strong></p>
<p>This total reversal of Linden's policy threatens to shut down most (fortunately not all) of the sites providing 24 million links to Linden's products and services; it threatens to deprive Second Life of hundreds or thousands of 3rd party services, websites, fan sites, blogs, Second Life®-specific media, artistic and cultural developments, educational and research efforts - not to mention thousands or dozens of thousands of the most energic "evangelisers" that have co-promoted Linden's products and technologies in the past which might, in less than three months, see their accounts banned and their content deleted with little or no hope of appeal.</p>
<h3>Open petition to Linden Research, Inc.</h3>
<p>The community of users of the Second Life® world always recognised, beyond a shadow of doubt, Linden's full right to its registered trademarks, which were almost always duly credited, and clearly stated their non-affiliation with Linden and that they had no intention of infringing in any of Linden's rights or claims to the trademarks. Some of those trademarks were never disputed, for several years since their registration and use by Linden, and Linden's claim to them is solid and universally accepted world-wide. Linden, in return, gently condescended to a limited usage of their registered trademarks for specific purposes, well stated in a clear document (the "Fansite Guidelines"). The very few exceptions where abuse occurred could be effectively dealt with by Linden's own legal advisers and were very reduced in number.</p>
<p>It is our belief that the extreme switch to the complete opposite of what has been actively promoted in the past four years is not a good marketing strategy - effectively, fighting off, one by one, all the most energetic promoters of Linden and their products, shutting down their right to talk and co-promote Linden's technology and environment, ban their accounts, and remove their content. A four-year policy grants (at least under estoppel) the large community of enthusiastic supporters the <em>moral</em> right to request from Linden a better model of co-promotion, one that is fair and balanced, protective of Linden's legal rights as valid owners of their registered trademarks, but also that allows "fansites" to continue to spread and promote Linden's products without fear of litigation.</p>
<p>We thus propose the following:</p>
<ol type="1">
<li>Accept that, by introducing the "Fansite      Guidelines" four years ago, Linden effectively allowed co-branding and      co-promotion of their registered trademarks, so long as these were      displayed on "website[s] created and maintained by residents or other      devotees of Second Life®, with content primarily focused on some aspect of      Second Life." and had no other purpose. These "Fansite Guidelines" lead to      fair expectations (under estoppel) of goodwill of Linden towards a fair      use of their trademarks without intention to infringe on any of Linden's      rights.</li>
<li>Rewrite, but not eliminate, the "Fansite      Guidelines" to be more strict, but still allow the usage of Linden's      trademarked words as part of the co-promotional effects, accepting that      their existence in no way invalidates Linden's claims on their registered      trademarks, but only serve as a vehicle for promotion and marketing.</li>
<li>Require that all such websites register      with Linden and formally accept the Guidelines (very similar to the      request for the display of the "inSL" logo). Remember your international      audience, too, and provide translations as well.</li>
<li>Reinforce the duty of all websites under      the "Fansite Guidelines" to be strictly compliant with these, or face a      Cease &#38; Desist letter/Takedown notice.</li>
<li>Request to all owners of such websites a      clear display of their non-affiliation with Linden or its subsidiaries,      stated clearly and unambiguously.</li>
<li>Reword the statements of the Brand Center,      which currently states that no requests for the usage of any of the      trademarks (with few exceptions) will be taken, and that most emails will      never be answered (or even read). Instead, work on a case-by-case basis,      grandfather existing products and services, and work with organisations,      groups, and companies owning those websites to make sure they clearly      comply with the Guidelines.</li>
<li>Request assistance from the users to      locate, identify, and report websites where your Fansite Guidelines are      not in compliance, or their non-affiliation with Linden is not being      clearly and unambiguously stated, or where your registered trademarks are      illegally used. Deal with each case separately and encourage first the      non-compliant websites to voluntarily display conforming information, and      threaten with a Cease &#38; Desist or takedown letter if they refuse.</li>
<li>Remove the threat to ban avatars from      users that have inadvertently ignored (or misunderstood) the Guidelines. Instead,      warn them and give due notice of their lack of compliance with the      Guidelines, encourage them to sign on and register their sites, and      validate their compliance after the warning.</li>
<li>Continue to invest in the world-wide      co-promotion of the "Second Life®" brand by launching different levels of      "affiliation programmes"; "inSL" is a good start but a very weak one with      limited value (no aggressive promotion by Linden of the logo and word).</li>
</ol>
<p>We would also request Linden to further clarify the potentially censurous policy towards residents implied in the guidelines in conjunction with the Terms of Service:</p>
<ol type="1">
<li>Clarify that the rules and policies outlined in the brand      guidelines under the heading of <a id="st9s" title="Proper Reference to Linden Lab's Brand Names in Text" href="http://secondlife.com/corporate/brand/trademark/reference.php">Proper Reference      to Linden Lab's Brand Names in Text</a> do not apply to cases covered by rights of free speech, including      but not limited to nominative use of trademarked terms under US law and      equivalent rights conferred upon users of the Second Life® service by      local legislation.</li>
<li>Clarify that Linden Research does not intend to ban or threaten to      ban users exerting the rights delineated above, independently of the      contractual relationship created by their usage of the Second Life® service.</li>
</ol>
<p>We feel that the above proposal, if correctly implemented, and duly promoted, will not only reinforce Linden's claim to their registered trademarks, but positively encourage their further widespread in all media, without hurting the millions of hours spent in the past year by dozens of thousand of users to promote and disseminate Linden's products and services world-wide.</p>

<content:encoded><![CDATA[<p>A <a href="http://gwynethllewelyn.net/" target="_blank">gwyneth</a>, depois do <a href="http://gwynethllewelyn.net/2008/03/26/second-life-bloggers-require-clarification/" target="_blank">Manifesto</a>,  acaba de publicar no seu blogue uma <a href="http://gwynethllewelyn.net/2008/04/05/petition-to-linden-lab-on-the-policy-of-trademark-enforcement/" target="_blank">Petição</a> sobre o assunto. Uma vez mais, nós, concordamos inteiramente com o texto e ele será reproduzido no post seguinte.</p>
<p>Duas breves considerações (pessoais):</p>
<p>1. A pretensão dos 'coisos' sobre o registro ou sobre a trademark de certos termos faz muito pouco sentido. A Gwyneth dá alguns exemplos e o termo <a href="http://en.wikipedia.org/wiki/Genericide" target="_blank">Genericide</a> é muito apropriado. Seria interessante ver a Bayer começar algo semelhante ao que os 'coisos' começaram por aparecer escrita a palavra 'aspirina' (só para dar um exemplo).</p>
<p>2. Fazendo uma busca através do <a href="http://www.marcasepatentes.pt/" target="_blank">INPI</a> (Instituto Nacional de Propriedade Industrial), podemos ver que a marca SL já está registada por várias empresas internacionais. Os 'coisos' estão, quanto a mim, a dar um tiro no pé.</p>

Tricia (she has cystic fibrosis) is in need of new lungs and is on the list for a transplant. Her daughter, Gwyneth Rose, is a preemie who is 7 weeks old and is 1lb and 10 oz.  Nathan is the husband of Tricia and the father of Gwyneth and has been blogging their journey. Its an incredible story and they are living out what it means to trust in the Lord and to be followers of Jesus Christ.</p>

<p>It's time for... a parable. I call this little ditty,</p>
<p>The Righteous Pothead and the Blissful Poet:</p>
<p>So... after a morning of day labor, me and this guy smoke a little weed. I was wearing the "standard wardrobe" at the time, namely a shirt with "a certain blond" drawn on the back, which is usually a good conversation starter...</p>
<p>(And remember... do not attempt to understand the poet of this tale. Included for illustration purposes only. Speaking of miracles in the "really real," <em>I</em> don't even know. I love her like... there ain't no like. I digress...)</p>
<p>So he mentions his interest in art, displays a few tattoos. Which naturally encourages me to display the "certain blond" inked on my forearm... and we talk about poetry, somehow; perhaps because I'm headed to the coffeehouse to recite some for open mic night. (Poetry celebrating a "certain blond") A stop along the way is required to gather said hard copy, namely a visit to my storage space, being otherwise homeless at the time. And naturally, he investigates the numerous (less than a hundred, anyway:) pictures of a "certain blond" doing a laudable impression of wallpaper...</p>
<p>(A sidebar, in case, perhaps, you wonder about the imagery. If you ever seen a movie which called for the set design labeled "standard stalker layout, full kit..." I completely understand the negative stereotyping fostered my the media by my tastes in fashion and interior design. I also understand if you devalue the "book" of me by the "ostentatious cover" of this "excessive display," which is merely my celebration of her magnificence. And I will even apologize to those in the crowd for inspiring any uncontrolled "gag reflex." I have heard it told that far from being universally loved, this "certain blond" inspires actual, physical pain in some individuals from the mere mention of her name... All I ask is that you read the fine print: In no way, shape or form, through threat, intimidation, or even through inserting my presence with a ten mile radius of her, cause her any pain, discomfort, fear or emotional distress... I just absolutely adore this poor girl... OK, I'm done. Back to the story...)</p>
<p>Later:</p>
<p>We talk, compare art, smoke more weed... and out of the blue, he tries to catch my eye with the unlikely question of:</p>
<p>"But surely, you don't love Gwyneth more than <em>God</em>, do you?"</p>
<p>And I said...</p>
<p>Can you guess my answer? Bonus: can you guess what I actually said?</p>
<p>Forget all that. Let's join together in the comforts of socially acceptable behavior and find comfort in traditional values. Let us go as far as to say I'm not only wrong, I'm so far from right in performing my "duties as prophet," I'm mapping new territory in the realm of blasphemy... imagining all that, care to bet your conviction of my "express train straight to hell" against my similar certainty of the wink and a smile from ol' Pete at the Pearly Gates with the greeting of, "You and your dang Gwynnies..."</p>
<p>Of course, the Blissful Poet didn't say a dang thing. Left that place like some hidden computer activated the ejection seat. Sure enough a guided missile suddenly appeared on the threat scope. But at the other end of the imagination scope. Say I am absolutely correct and my actions are fully sanctioned, yet disaster occurs in the unfortunate "ascension"  of a "certain blond" into the state-sanctioned "divine manifestation" of the more historically accurate aspect of the "creator" as "Goddess..." Let the record show...</p>
<p>Aw, relax. It's just a story, I'm just an obsessed freak posing as a monkey with a typewriter. Obviously insane. Surely cannot expect to be taken seriously in comparing some "moronic crush" on a movie star to the Divine Office ensconced with thousands of years of tradition and ritual... the very cornerstone upon which rests the entire weight of modern civilization... yet I seem to remember hearing of this other guy with a construction gig who surely had no intention of creating a new religion, just wanted to fix what was broken... (mumble, mumble) cornerstone of modern society (mumble, mumble) and has it not become... (mumble, mumble) celebrity worship <em>is</em> the state-sanctioned... (mumble, mumble) distract from the context of the <em>actual</em> "true, universal, modern religion" (mumble, mumble) all about the <em>green</em>...</p>
<p>And the moral of the story is (other than being a vehicle clearly driven by my issues:)</p>
<p>A couple of people can sit down and have a conversation speaking the same language, using words and phrases only with their most basic objective intent, yet communicate vastly different concepts... (an hour later...) What I'm really trying to say... cannot be said. Whether or not you are not reading or ignoring, devouring or skimming this missive, this rant, this pathetic display of an infatuated loser who has nothing to say and no way to say it... I'm looking at a picture of a "certain blond."</p>
<p>It is incorrect to state that "god is love." The more accurate form would be "love is god."</p>
