"Anata To" is the second collaborative release put together by singer-songwriter and pop starlet ayaka and the folk duo who has been making tidal waves in the Japanese music scene for the last few years, Kobukuro.  The song is a nice ballad.  It is being released in CD-Only format under the Warner Music Japan label on September 24th, 2008.  The cover is very similar to the cover of their previous collaborative efforts, "WINDING ROAD"

"...the issue is what the definition of 'unreasonable' is "

Ahem. No. It isn't.

Strangely enough, almost as if the authors had actually thought about the matter, the constitution's fourth amendment provides a very specific definition for "reasonable":

Probable cause, supported by oath or affirmation, a description of the place to be searched, and the persons or things to be seized, which in turn forms the basis for issuing a warrant, and the warrant itself is the legal pivot upon which the authorization of the federal government to search, or not search, depends.

The states must follow this definition because the 14th amendment says "No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States." Local jurisdictions in their turn must follow suit because they must comply with the laws of the state they exist within.

As can easily be understood, any argument about "reasonable searches" not being explicitly defined in the 4th amendment is entirely sophist. There it is; how much plainer could it possibly be? So with the understanding that the 4th goes into very specific detail on exactly that subject, and was written by people whose primary interest was limiting federal power, you simply cannot say that the conditions required for a reasonable search aren't laid out in there. You also certainly can't say that the terms for an unreasonable search are laid out in there — those aren't unreasonable terms, they're reasonable terms.

So, with the specific and explicit definition of what 'reasonable" is right in hand, as given by the constitution itself, the definition of "unreasonable" is crystal clear: anything that doesn't match those requirements. Anything.

Now, if congress wants some other definition of "reasonable" in there, then amazingly enough, there is a mechanism specifically provided for them to get that accomplished; that is article V, Amendment. There is no other way they can legitimately effect such a change.

They can, however, assert unauthorized power by simply making unconstitutional legislation, just as they have with ex post facto laws, the inversion of the commerce clause, various kinds of censorship, and an entire laundry list of other unauthorized power grabs; and in such an effort, they will continue to enjoy the support of the executive and the judiciary, because after all — they're all part of the same system, and all benefit from accruing additional power.

Consequently, it is very important that we, as citizens, remain cognizant of the difference between the authorizations of power made by the constitution, and the naked grabs for unauthorized power made by oath-breaking members of the executive, congress, and the judiciary. What little power we have — essentially fractional measures (votes) of "throw the bums out" with regard to our own members of congress, and the executive — should be used whenever we detect such unauthorized activity.

The problem is that most people don't bother to read the constitution, and are wholly unaware that the federal government has widely violated its constituting authority in many areas; there's an almost impossible obstacle to overcome with regard to informing the public as to just how far outside the lines the federal government has extended itself.

Please. Go get a copy of the constitution. Read it. Read the federalist papers. Read the history of the Virginia constitution. Read everything Thomas Jefferson ever managed to get on paper, throw out the parts on slavery, and cherish the rest. Likewise, dig up Benjamin Franklin's comments, and, after getting over what a happy pervert he was, commit the rest to memory. Then read the constitution again.

The constitution is literally the constituting authority for the US federal government. To any degree that they do not comply with this document, they are engaged in unauthorized exercise of power. Use your vote to remove anyone you catch voting for unconstitutional legislation. That's the best thing you could possibly use a vote for. Seriously. There is no higher calling than moving this country closer to the exalted state of liberty made possible by the constitution.

Oh, and by the way — that whole laptop thing? In the vast majority of cases, they are entirely without probable cause, so there is no authority to either search one or seize one. See how easy that was to figure out? And isn't it amazing that they figured this out over 200 years ago without the help of any modern legislator?

Vote 'em out, friends — vote 'em out.

But yeah it was fun!!  And I didn't get a chance to take pictures because my friend wasn't there today, and I'm leaving tomorrow (Tuesday) for CA.  I have to get up at FIVE AM!!!!!! EEEEEEEEEKK!!!!!!  That's not fun!!

The Chester-le-street Cavaliers narrowly missed out on a top three finish in this 12 club league by just 3 points. Unfortunately, they needed to finish in the top 3 to recieve prize money, however this brilliant little league has gave the Cavaliers' inevitable experience for the Season and Leagues ahead.

In 2003, Savana Redding, a 13-year old eighth-grade honor student, was forced to strip for Arizona school officials looking for 2 over-the-counter ibuprofen pills.

When the Vice Principal pulled her out of class, Savana agreed to a search of her backpack.  When nothing was found, Vice Principal Kerry Wilson ordered a female secretary and the school nurse to strip search her without bothering to even contact her mother.

The secretary had Savana take off all her clothing except her underwear. Then she told her to "pull her bra out and to the side and shake it, exposing her breasts," and "pull her underwear out at the crotch and shake it, exposing her pelvic area." Sometimes it's hard to tell the difference between drug warriors and child molesters.

"I was embarrassed and scared," Savana said in an affidavit, "but felt I would be in more trouble if I did not do what they asked. I held my head down so they could not see I was about to cry." She called it "the most humiliating experience I have ever had." Later, she recalled, the principal, Robert Beeman, said "he did not think the strip search was a big deal because they did not find anything."

Is this what "zero tolerence" is all about?  We all know the saying, but seem to forget that it's message holds especially true when it comes to surrendering authority to the government.

Be careful of what you wish for, you just might get it!

These school authorities clearly violated Savana and her constitutional rights, however, the courts first held that the school didn't violate the Fourth Amendment because officials have a legitimate interest in protecting students from prescription drugs.  Luckily, a federal appellate court ruled that the school officials did violate Savana's constitutional rights.

"A reasonable school official, seeking to protect the students in his charge, does not subject a thirteen-year-old girl to a traumatic search to ‘protect' her from the danger of Advil," the court wrote in today's opinion. "We reject Safford's effort to lump together these run-of-the-mill anti-inflammatory pills with the evocative term ‘prescription drugs,' in a knowing effort to shield an imprudent strip search of a young girl behind a larger war against drugs."

"It does not take a constitutional scholar to conclude that a nude search of a 13-year-old girl is an invasion of constitutional rights. More than that: it is a violation of any known principle of human dignity," the court continued.

But it's not over ... the government and their "do-gooder" constituency aren't going to give up, and they've got the Supreme Court in their back pocket!

In a 1985 decision upholding a high school principal's perusal of a purse belonging to a freshman who was caught smoking in the girls' room (a search that found marijuana as well as cigarettes), the Court said public school officials, as agents of the government, are bound by the Fourth Amendment's prohibition of unreasonable searches and seizures. But given the importance of maintaining order at school, it said, officials do not need a warrant or probable cause to search a student; it's enough that the search is "justified at its inception" and "reasonably related in scope to the circumstances which justified the interference."

In subsequent cases, the Court has indicated that a search can be deemed reasonable even when officials have no grounds to suspect a student has done anything wrong. In 1995 it upheld random drug testing of student athletes, and in 2002 it said that requirement could be extended to all students participating in extracurricular activities.

To justify compelling a student to urinate into a cup under a teacher's supervision and surrender the sample for laboratory analysis, the Court not only did not require any evidence that the student was using drugs; it did not require any evidence of a drug problem at the school. The fear of potential drug problem was enough, in its view, since "the nationwide drug epidemic makes the war against drugs a pressing concern in every school."

Light, sweet crude for August delivery ended this week at $128.88 after losing 41 cents on Friday on the New York Mercantile Exchange.

The Friday decline followed tumbles of $5.31 on Thursday, $4.14 on Wednesday and a drop of $6.44 on Tuesday.

Just last week, crude traded above $147 a barrel.

While experts are not rushing to declare that the run that has seen oil prices roughly double in a year may be over, some were sounding notes of caution.

"If this is not the bubble's implosion, then it's a reasonable facsimile," said analyst and trader Stephen Schork in daily market commentary.

"Perhaps all we have witnessed was a replay of last August's subprime induced sell-off. Time will tell. Nevertheless, for the time being we no longer care to hold a bullish view," Schork said.

Oil's big fall has translated into a small decline at the gas pumps.

The gasbuddy.com website said the average price in Canada for a litre of regular unleaded gasoline on Friday was $1.37871, down from $1.38968 on Thursday, and off from $1.39559 a week earlier.

For years, I guess, it just never crossed my mind… until this past Friday. When I awoke, I said to myself, “I’m going to shave my head.” And, with that, I took out the electric clippers, the shaving cream, and the razor. An hour and half later my head was as smooth as a baby’s bottom.

In the hall where my wife saw my Bic-ed head for the first time, I was met with, “Oh my God. You shaved it!” Her queer smile was a mixed expression of disbelief, astonishment, and curiosity. By nightfall, as well as the following days, she revealed, “It’s growing on me.”

That afternoon when we were at the base lake with my folks and their friends in celebration of the Fourth of July, I received a lot of compliments from the men. The reactions from the women were equal to my wife’s. I think women value and distinguish a person’s hair a lot differently than men. Nonetheless, nobody out-and-out said they disliked it. If they had, oh well, it’s my head and my choice. And, I like it!

One thing a lot of people got a kick out of was when my mother came looking for me.

Some guys and I finished up a game of horseshoes and were returning to the line of picnic tables where all of the food was beginning to pile up from people bringing cold dishes and the hot plates of meat fresh off the grill. I had no idea she was looking for me because I had my back turned and was speaking with someone. Interrupting the conversation, I heard a woman calling for me: “Norman! Norman, your mom… she’s here.”

I turned around and there she was, my mother, looking straight at me without recognition. Then, she burst out in disbelief and astonishment at my bald head. Muttering some things in Korean at first, she started in on her commenting in English. “Norman! What did you do?” She rubbed my head and patted my shoulder. “You look like your uncle,” she observes. My uncle shaves his head because he is half bald and prefers to be youthful without his receding hair line revealing his age. “Ahh, you’re still handsome. My son!” She smiles and proudly takes me by the hand and parades around the growing number of party goers. Everybody knows me, but it seems to be a Korean thing to parade your child like a trophy around to everyone, especially mother-to-mother. It is really more about showing off and receiving praise, but children do it because it makes their parents happy. Hell, the other mothers do it, too, and we return the gesture.

It felt weird when my wife rubbed down my bald head with sun block. She commented with a giggle and a blushing face I did not see but heard, “Wow! It’s smooth!” I think she found it a turn on. That night when we made love in a somewhat exhibitionist-style inside the tent with all kinds of passers by just outside, my wife repeatedly rubbed head, which she normally does not do. I enjoyed it feverishly.

Conclusion

Despite most people I know discouraging me from Bic-ing my head, I did it anyway. I fulfilled a long awaited wish in my personal image, stirred up some folks, enlivened my wife, and increased my self-confidence. Nonconform is the norm.
